Terms of sale
This English translation is provided for convenience; the French version is the only legally binding one.
These general terms and conditions of sale govern sales made through the website esprit-lumieres.com by Marianne Hubert, sole trader (entrepreneur individuel), registered under SIRET 510 021 397 00029.
1. Ordering by quote
As most of the pieces offered are one of a kind, purchases are made through a quote request. Once the customer has approved the quote and paid, production begins.
2. Prices
Prices are stated in euros. VAT not applicable, article 293 B of the French General Tax Code (CGI). They include workshop costs but exclude delivery, the cost of which is specified on the quote.
Payment is made by bank transfer, upon receipt of the invoice sent when the quote is accepted. The bank details and the transfer reference appear on the invoice.
3. Lead time, shipping and delivery area
Pieces are shipped within 7 working days after the quote is approved, except for made-to-measure orders, whose lead time is specified case by case (generally 4 to 6 weeks).
The workshop delivers within France and to the other Member States of the European Union. The delivery method and price are specified on the quote. Pickup points are only available in France. Pieces can also be collected free of charge from the workshop in Villemomble, by appointment.
4. Right of withdrawal
In accordance with article L.221-28 3° of the French Consumer Code (Code de la consommation), the 14-day right of withdrawal does not applyto goods made to the consumer’s specifications or clearly personalised. This concerns in particular made-to-measure lampshades and one-of-a-kind pieces assembled specifically to order.
For fabric remnants and non-personalised accessories, the right of withdrawal applies as normal (14 days from receipt).
5. Warranties
The pieces are covered by the legal warranties of conformity and against hidden defects (articles L.217-3 et seq. of the French Consumer Code, articles 1641 et seq. of the French Civil Code).
6. Disputes
In the event of a dispute, the customer should first contact the workshop at [email protected]. Failing an agreement, the customer may use consumer mediation.
These terms are governed by French law. This choice does not deprive a consumer who resides in another Member State of the European Union of the protection afforded by the mandatory provisions of the law of their country of residence. Any dispute falls within the jurisdiction of the competent courts under the applicable rules; in particular, a consumer may bring proceedings before the courts of the place where they reside.
